๐Ÿ“˜What is B-BBEE?

B-BBEE stands for Broad-Based Black Economic Empowerment. It is a government scoring system that rewards businesses owned, run, or staffed by black South Africans. The higher your score, the more preference points you earn on tenders โ€” and the more likely you are to win.

Levels run from Level 1 (best) to Level 8 (lowest), plus "Non-Compliant".

๐Ÿ‘ฅWho counts as 'black'?

Under the B-BBEE Act, "black" includes African, Coloured, and Indian South African citizens โ€” by birth, descent, or naturalised before 1994 (or who would have qualified if not for apartheid law).

Extra recognition goes to black women, black youth (under 35), and black people with disabilities โ€” the so-called "designated groups".

๐Ÿ“ŠBusiness size โ€” which scorecard applies?

The scorecard you must use depends on your annual turnover. Most small businesses are EMEs and need only a free affidavit.

๐Ÿ’ฐ80/20 vs 90/10 scoring

Every government tender is scored out of 100 points. Price always carries the most weight, but B-BBEE and other goals (youth, women, locality) can decide a close fight.

Worked example. Two bidders compete for a R900 000 tender (80/20). Mandla quotes R950k, B-BBEE Level 1 โ†’ roughly 75 + 20 = 95 points. Johan quotes R900k, B-BBEE Level 4 โ†’ roughly 80 + 8 = 88 points. Mandla wins despite the higher price.

๐ŸงญGuidance for different ownership profiles

  • 100% black-owned EME: Automatic Level 1. Free affidavit. Maximum preference points.
  • 51%+ black-owned: Automatic Level 2 (EME/QSE). Use a sworn affidavit.
  • 30โ€“50% black-owned: Get verified โ€” partial black ownership still lifts your level.
  • White-owned SMEs: You can still bid and win. Boost your score with skills development (train black staff), supplier development (use black-owned suppliers), and enterprise development (mentor smaller firms).
  • JV strategy: Many white-owned firms partner with a black-owned EME on a Joint Venture (JV) โ€” combining capacity with B-BBEE level.

โš ๏ธFronting is a crime โ€” don't even think about it

Putting a black person's name on the share register without giving them real ownership, control or benefit is fronting.

  • Up to 10 years in prison
  • Fines up to 10% of annual turnover
  • Blacklisting from government work for 10 years
  • The B-BBEE Commission actively investigates tips and audits.

Keep these documents ready in a single folder so you can bid the same day a tender appears.

  • CIPC company registration certificate
  • Up-to-date SARS Tax Compliance pin (TCS)
  • CSD registration & MAAA number
  • B-BBEE affidavit (EME/QSE) or verified certificate
  • Bank confirmation letter (within 3 months)
  • Letter of Good Standing (COIDA)
  • UIF registration proof
  • Owner ID copies (certified within 3 months)
  • Reference letters from past clients

๐Ÿ’กMyth-busting

  • "White-owned businesses can't win tenders." False. You'll just need a sharper price, better B-BBEE strategy, or a JV partner.
  • "Level 1 = automatic win." False. Price still carries 80โ€“90 of 100 points.
  • "B-BBEE is the same as Affirmative Action." No. AA is about employment; B-BBEE is broader โ€” ownership, management, skills, suppliers and community.
  • "A real certificate is always better than an affidavit." Not for EMEs. The free affidavit carries the same weight.
  • "I need a fancy verifier." Only Generic Enterprises (R50m+) need a SANAS-accredited verifier.
